THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.24449 of 2015 ORDER:

The prayer of the petitioners in this writ petition is as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus by declaring the inaction of the respondents 1 to 4 in taking action on the representation dt.23.05.2012 of the petitioners to implicate all the respondent Nos.5 to 9 as accused into the crimes detailed out in the representation, is illegal, arbitrary, violative or Articles 14 and 21 of the Constitution of India and consequently direct the respondents to include all the respondent Nos.5 to 9 in all the crimes detailed out in the representation dt.23.05.2012 and pass such other order/s as this Hon'ble Court may deem fit and proper in the circumstances of the case."

However, perusal of the representation dated 23.05.2012 made by the petitioners reflects that they are not complainants in any of the 25 crimes which have been detailed therein.

The written instructions furnished by the Assistant Commissioner of Police, WCO-I Team, CCS, DD, Hyderabad, state to the effect that the two cases in which the 2nd petitioner herein was the complainant are Crime Nos.278 and 332 of 2014. These two cases are stated to be at the stage of investigation. When asked as to whether the petitioners' would have locus to ask for inclusion of the unofficial respondents herein as the accused in the 25 crimes detailed in their representation dated 23.05.2012, Sri Parsa Ananth Nageswara Rao, learned counsel, was unable to answer.

In that view of the matter, this Court is of the opinion that the writ petition is utterly misconceived and that the petitioners are only seeking to settle their private issues with the unofficial respondents herein by attempting to get them included in various pending crimes in

which they are not even the complainants.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
