THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.26667 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking a direction to the 3rd respondent to register a crime and investigate into the same basing on the complaint lodged by the petitioner dated 06.04.2016.

The main grievance of the petitioner is that the Station House Officer, Town Police Station, Tadepalligudem, West Godavari District-3rd respondent herein is not registering a crime basing on the complaint lodged by the petitioner dated 06.04.2016.

Considering the facts and circumstances of the case, the petitioner is directed to lodge a fresh complaint before the 3rd respondent and the 3rd respondent is directed to register a case basing on the complaint that may be lodged by the petitioner if the said complaint discloses any cognizable offence and investigate into the same and file a final report if any, in accordance with law. If the petitioner is aggrieved by the action of the 3rd respondent, he is at liberty to approach the superior officer of 3rd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.
