THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8760 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.71 of 2023 on the file of Madhura Nagar Police Station, Hyderabad, registered for the offences under Sections 417, 420 and 376 of IPC.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the de-facto complainant is that she was married on 10.06.2020 and her husband is a village volunteer. After marriage, the petitioner allegedly sent love proposal to her. The differences arose between her and husband. She shifted to Hyderabad and started staying at her friend's place. Thereafter, the complainant and the petitioner started living together in Hyderabad having rented premises for a period of 9 months, before the complaint was lodged. It is alleged in the complaint that petitioner had mixed alcohol in

cool drink and forced her to drink and in intoxicated condition, photographs were taken and the petitioner had sexual intercourse with her. Thereafter, he started black mailing her having nude photographs and videos. 4.

As seen from the record, both, the de-facto complainant and the petitioner stayed together for a period of 9 months. The neighbours where they lived are examined. As seen from the remand report, major part of the investigation is complete. In the said circumstances, petitioner who is in jail can be granted the relief of regular bail, subject to following conditions:- i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of XIV Additional Chief Metropolitan Magistrate, Hyderabad.

ii) The petitioner/Accused after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks or till the charge sheet is filed, whichever is earlier, for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
