THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.571 of 2016 ORDER:

This Criminal Petition is filed by the petitioners under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in an unregistered crime.

Heard and perused the material available on record. It is stated that the 2nd petitioner is the brother of the husband of one K. Hema Madhuri. The 1st petitioner is the wife of the 2nd petitioner. The husband of the said Hema Madhuri filed O.P. against her and on coming to know about the same, she lodged a complaint in Mahila Police Station, Srikakulam against her husband and his relatives. Therefore, the petitioners apprehend arrest. Learned Public Prosecutor submitted that no crime was registered against the petitioners.

Considering the above submission made by the learned Public Prosecutor, this Court is not inclined to grant the relief prayed by the petitioners. However, the respondent-police concerned are directed to issue notice under Section 41-A Cr.P.C. to the petitioners, if any case is registered against them.
