CVNR, J & TR, J AS. No.648 of 2004 JUDGMENT: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This appeal arises out of common order and decree dated 13.11.2002 insofar as it pertains to O.P.No.4 of 2000 on the file of the Senior Civil Judge, Adilabad is concerned.

Mr. K. Raghuveer Reddy, learned counsel for the respondents addressed a letter dated 23.02.2017 wherein it is stated that A.S.No.519 of 2004, filed against the common order in O.P.No.125 of 1999, was disposed of by this Court by judgment dated 23.04.2007. He has enclosed a copy of the said judgment, a perusal of which shows that this Court has allowed the appeal in part with the following modification of the decree of the reference Court:

1. That awarding of interest by the reference Court on additional market value and solatium from the date of taking possession be and hereby is set aside.

2. That the claimants be and hereby are entitled to 12% additional market value on the enhanced compensation from the date of notification to the date of passing award and interest at 9% per annum from the date of notification for a period of one year and thereafter at 15% per annum,

3. That the claimants are also entitled to 30% solatium on the enhanced compensation and on which they are entitled to interest as indicated above,

4. That save as aforesaid, the decree of the Court below do stand confirmed in all other respects,

5. That there be no order as to costs in this appeal." Learned Government Pleader does not dispute the fact that the issue decided in A.S.No.519 of 2004 covers this case as well as this appeal arises out of the common award of the reference Court against O.P.No.4 of 2000.

CVNR, J & TR, J AS. No.648 of 2004 In the light of the above, this appeal stands disposed of in terms of the judgment dated 23.04.2007 passed in A.S.No.519 of 2004 with the direction that the reasons and directions contained therein shall form part of this order.
