THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40459 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 5th respondent in not adding Section 307 IPC in Crime No.340 of 2014 and not investigating in to the case basing on the complaint of the petitioner, dated 04.09.2014, as illegal and arbitrary.

Heard and perused the material available on record. The main grievance of the petitioner is that the Station House Officer, Humayunnagar Police Station, Hyderabad - 5th respondent is not adding Section 307 IPC in Crime No.340 of 2016 on the basis of the complaint lodged by the petitioner on 04.09.2014 in respect of the incident, which occurred on 03.09.2014, and also not investigating into the above crime.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, 5th respondent is directed to conduct investigation in the above crime, complete the same and file a final report in either way, as expeditiously as possible.

Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J November 23, 2016.
