THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No. 117 of 2015 ORDER: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) In this matter no question of contempt arises, as we notice that the petitioner's term was to expire on 07.11.2014 and we delivered the judgment on 19.11.2014 by which date the petitioner lost all his rights to be reinstated in terms of the judgment because of expiry of three years. Nonetheless, with deference to the order of the Court technically by passing an order the petitioner was reinstated. According to us, such reinstatement was not required, but in compliance of our order it was done. We clarify that on the strength of the order of reinstatement, the petitioner cannot be allowed to perpetuate in office. The contempt case is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
