O R D E R
The petitioner is aggrieved by the inaction of the police authorities in initiating
departmental and criminal proceedings against the Sub-Inspector of Police, Bhimadole Police Station, Bhimadole, impleaded eo nomine as the sixth respondent. The petitioner alleges that the sixth respondent harassed her sexually, physically and mentally and she accordingly sought action against him. The Deputy Superintendent of Police, Narasapur, West Godavari District, filed a counter-affidavit stating that the Superintendent of Police, West Godavari District, acting upon the complaint of the petitioner, conducted an enquiry into the matter. The enquiry revealed that in order to wriggle out of a criminal case registered against her under Crime No.151 of 2010 under Sections 109, 290 and 309 IPC, the petitioner threatened the police and created a baseless story.
The enquiry further revealed that her hotel establishment was kept open beyond the permitted time late into the night despite the warnings given to her by the police authorities. The letter addressed by the Superintendent of Police, West Godavari, to the Deputy Inspector General of Police, Eluru Range, on 16.10.2010, speaking of the above facts, was also made part of the record along with the counter. No reply affidavit was filed by the petitioner rebutting the averments made in the above counter-affidavit.
In the light of the aforestated facts, the allegation of the petitioner that the police authorities had not taken any action in respect of her complaint is found to be factually incorrect. Having applied their mind, the police authorities found that no case was made out for initiating departmental and criminal proceedings against the Sub-Inspector of Police, Bhimadole Police Station, West Godavari District. In that view of the matter, this writ petition is without merit and is accordingly dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
