HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35604 of 2016 ORDER:
This writ petition is filed seeking to call for the records relating to Crime No.161 of 2016 registered by SHO, Korukonda Police Station, Rajahmundry Urban, for the alleged offences under Sections 506 read with 34 IPC and Section 3(1)(r)(s) and Section 3(2)(va) of SC & ST (POA) Act, 1989, as illegal and arbitrary. Heard and perused the material available on record. It is the case of the petitioner that the 4th respondent has lodged the present complaint alleging that she was in live-in relationship with the petitioner for the last 30 years and now it is alleged that the petitioner is abusing the 4th respondent in filthy language in the name of her caste and threatened her and her children to leave the village.
The grievance of the petitioner is that the 4th respondent lodged the present complaint based on the false allegations and with a view to part with his property in their favour and that subsequent to the registration of the crime, the respondent police are trying to arrest the petitioner and that the 2nd respondent through the police is bringing pressure on the petitioner to part with his property in favour of the 4th respondent and her children. Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in Crime No.161 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
