THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6887 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A2 to A4 seeking bail in the event of their arrest in connection with Crime No.187 of 2022 on the file of Adilabad II Town Police Station, Adilabad District, registered for the offences punishable under Sections 363, 354-A, 294-b, 506, 342 of Indian Penal Code and Section 3(2) (va) of SC & STs (POA) Act and Section 12 & 17 of POSCO Act.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

It is alleged in the complaint that Accused No.1 was asking for sexual favour from the victim girl who is aged around 15 years. On 29.07.2022, Accused No.1 along with these petitioners who are his family members, went to the house of the victim girl and took her to their house. The Victim girl managed to escape in the evening and conveyed the matter to her mother, who field a complaint.

As seen from the complaint, the allegation against these petitioners is that they have helped Accused No.1 in keeping the victim girl in their house.

However, according to learned counsel for the petitioners false complaint is made to implicate these petitioners who are parents and brother of accused No.1.

As seen from the complaint, allegations are leveled against Accused No.1 who is already arrested on 29.07.2022. In the said circumstances these petitioners who are parents and brother of the Accused No.1 can be granted the relief of Anticipatory Bail in the event of their arrest, subject to the following conditions:

1) The petitioners/A2 to A4 are directed to surrender before the Station House Officer, Adilabad II Town Police Station, Adilabad District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer, shall release the petitioners/A2 to A4 on bail, on their executing personal bonds for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners 2 & 3/A3 & A4 shall appear before the police every day between 10.00 a.m. to 1.00 p.m. for a period of four weeks, for the purpose of investigation. The petitioner No.1/A2 shall appear before the concerned police as and when directed.

3) The petitioners/A2 to A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
