HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6555 OF 2018 ORDER:

The petitioner is A6 among thirteen accused in Crime No.70 of 2018 on the file of Dharmapuri Police Station, Jagtial District. The crime is registered on 09.05.2018 for the offences punishable under Sections 302, 120-B, 109 r/w 34 IPC and Sections 25(1B)(a) & 27 of the Arms Act, 1959.

Heard the learned counsel for petitioner and the learned Public Prosecutor and perused the F.I.R., the entire case diary, the bail application averments and the medical record of petitioner, who underwent angiogram. 3.

The contention of the learned counsel for petitioner that, the petitioner is innocent and was falsely implicated and there is no role of him even from the remand report of A11 placed on record for not among those persons at the field like A2, A3, A8 & A9 and he is suffering from illhealth and thereby, he may be enlarged on bail, cannot be considered, that too when the investigation is in progress and from perusal of the case diary, particularly the remand report of petitioner and others among A3 and A5 to A8 dated 16.05.2018 shows some substance for

Dr. SSRB,J Crl. P.No.6555 of 2018 opposing of the bail application by the learned Public Prosecutor and also privy to the crime.

The further contention of learned counsel for the petitioner, that the petitioner has no wine shop and much less with licence since long prior to the occurrence and there is no basis to say that he is privy to other accused to eliminate, is premature to come to a conclusion, that too when investigation is pending and in the process of filing final report to that effect. 5.

Having regard to the above, this Criminal Petition is dismissed which is not prejudice to the petitioner for renewal of request from any changed circumstances after completion of investigation. The Dharmapuri Police Station, Jagtial District shall complete the investigation and file the final report at the earliest.
