THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.640 OF 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit the petitioner herein prays that this Hon'ble court may be pleased to issue a writ, order or direction more particularly one in nature of writ of Mandamus, declaring the action of Respondents 3 to 4 in not filing final report for taking cognizance of offence and consequent arrest of Respondent no.5 in Crime No.242 of 2015 on the file of Kurnool II Town P.S., Kurnool District as illegal and arbitrary and consequently direct the Respondents 3 to 4 to file final report for taking cognizance of offence and consequent arrest of Respondent no.5 in Crime No.242 of 2015 on the file of Kurnool II Town P.S., Kurnool District and to pass such other orders as this Hon'ble Court may deem fit and proper in the circumstances of case, in the interest of justice."

Learned Assistant Government Pleader for Home placed on record a copy of the charge sheet in relation to Crime No.242 of 2015 on the file of Kurnool II Town Police Station, which was filed before the learned Judicial Magistrate of First Class, Kurnool. The police opined therein that the accused had prima facie committed an offence and that they were accordingly laying a charge sheet.

In the light of the afore-stated development, the cause in this writ petition does not survive for consideration on merits. The writ petition is accordingly closed.
