Nuchu Gopal Yada v. The Principal Secretary Home Department Secretariat,
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.20917 OF 2011 DATED: 24.06.2015 Between:
Nuchu Gopal Yada .. Petitioner And The Principal Secretary, Home Department, Hyderabad, and another.
.. Respondents THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.20917 of 2011 ORDER:
The grievance of the petitioner in this case was that his representation dated 12.03.2011 was not being disposed of. The afore-stated representation was made by way of a telegram and was addressed to the Commissioner, Cyberabad, Ranga Reddy District, who was not even made a party to the writ petition. The said complaint was made in the context of Crime No.454 of 2007 which was registered under Sections 109, 419, 420, 468 and 471 I.P.C. on the file of Malkajgiri Police Station, Cyberabad. However, the material placed on record by the petitioner himself reflects that upon due investigation, a final report was filed by the police authorities under Section 173 Cr.P.C. before the learned X Metropolitan Magistrate, Cyberabad, at Malkajgiri, reporting lack of evidence. In the light of the afore-stated conclusion arrived at by the police authorities, the proper remedy for the petitioner was to file a protest petition before the Court concerned. Without doing so, he seems to have submitted a representation to the police authorities which, in any
event, could not be acted upon once the Court was seized of the matter.
Reserving liberty to the petitioner to do so at least at this stage in accordance with law, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
