THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.9893 of 2025 ORAL ORDER:

Seeking the Court to enlarge the petitioner, who is arrayed as accused No.14 in Crime No.63 of 2025 of Rein Bazar Police Station, Hyderabad, registered for the offences punishable under Sections 191 (2), (3) & 103 read with Section 3 (5) & 190 and 61 (2) of BNS, 2023 and Section 4 read with 27(1) of Arms Act, 1959, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 14.04.2025, the de-facto complainant lodged a report with the Police stating that on 14.04.2025, he received call from his father as he informed him that some people were attacking his brother beside Deluxe medical shop near Dabeerpura, Hyderabad and requested to rescue him. Therefore, he immediately left home to reach the scene, when he reached there he noticed his brother was found dead with bleeding stab injuries on face, neck and other parts body and further stated that some persons stabbed his brother armed with knives and murdered

him. That during the month of Ramdan on 23.03.2025 the above said persons manhandled his brother along with some others and now they planned and murdered his brother. 3.

Basing on the said complaint, the police registered a case against the accused persons vide Crime No.63 of 2025, for the above said offences.

Heard Mr. N. Gopi Krishna, learned counsel appearing on behalf of Mr. Y. Soma Srinath Reddy, learned counsel for the petitioner on record as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent - State.

5. Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and the petitioner is no way connected with the said offences. He further submitted that the petitioner was arrested on 14.07.2025 and that the material part of the investigation has been completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the

petitioner by contending that the allegations against the petitioner were serious in nature and that the investigation is in progress and if the petitioner is released on bail, at this stage, he may tamper with the evidence and may threaten the witnesses. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it is observed that the petitioner is in jail from 14.07.2025 and as the material part of the investigation is completed and considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioner subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned VII Additional Chief Metropolitan Magistrate, Hyderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 A.M., on every Monday for a period of eight (8)

weeks, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 483(3) of BNSS.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
