HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 12112 of 2012 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. With the consent of the parties, the writ petition is disposed of at the admission stage itself.

The case of the petitioner is that he purchased land admeasuring Acs.7.06 guntas in Survey No.502 situated at Gudimalla Revenue Village, Khammam Rural Mandal, Khammam District, from one Monala Ramulu vide a registered document No.142 of 2011 dated 24.01.2011 for a valid sale consideration, and since then, he is in possession and enjoyment of the same. It is stated that pattadar passbooks and title deeds were issued to the vendor of the petitioner. It is also stated that the petitioner made a representation dated 10.02.2011, to the 3rd respondent, seeking issuance of pattadar passbooks and title deeds and also mutation of his name in the revenue records. As there was no response, the petitioner made another representation on 20.05.2011, but till date, no order came to be passed. The inaction on the part of the 3rd respondent in considering the representations of the petitioner led to filing of the present writ petition.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the 3rd respondent to dispose of the representations of the petitioner, at the earliest.

The learned Government Pleader for Revenue filed a

counter opposing the writ petition and also disputing the ownership of the petitioner, but however, submits that he has no objection, if a direction is given for disposal of the representations of the petitioner, if the same are still pending consideration.

Since the grievance of the petitioner is only with regard to the inaction on the part of the 3rd respondent in not considering his representations, without going into the merits of the case, the Writ Petition is disposed of, directing the 3rd respondent to dispose of the representation dated 20.05.2011 made by the petitioner seeking issuance of pattadar passbooks and title deeds and also mutation of his name in the revenue records in respect of the land admeasuring Acs.7.06 guntas in Survey No.502 situated at Gudimalla Revenue Village, Khammam Rural Mandal, Khammam District, if it is still pending consideration, in accordance with law, within a period of twelve

(12) weeks from the date of receipt of a copy of the order. There shall be no order as to costs.

Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed.
