THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE Dr. JUSTI CE SHAMEEM AKTHER CI VI L MI SCELLANEOUS APPEAL No.94 of 2008 JUDGMENT: (per Justice Sanjay Kumar) This appeal arises out of the order dated 12.06.2007 passed by the learned Chief Judge, City Civil Courts, Hyderabad, in O.P.No.362 of 2005. We are now informed that Award dated 02.11.2010 was passed by the Lok Adalat, City Civil Court Legal Services Authority, Hyderabad, in Arbitration O.P.No.280 of 2010 pending between the parties, whereunder not only the dispute in the said O.P. but also the dispute which is the subject matter of this appeal was also settled. Para 3 of the Award specifically refers to this appeal and also O.P.No.362 of 2005 from which it arises.

Sri Challa Gunaranjan, learned counsel for respondent No.1, would state that in terms of the aforestated Award, the amounts due in relation to O.P.No.362 of 2005 have also been paid.

In that view of the matter, the cause in this civil miscellaneous appeal no longer survives for consideration on merits. The civil miscellaneous appeal is accordingly closed in terms of the aforestated Award.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
