THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER M.A.C.M.A. No. 2488 OF 2005 JUDGMENT:

This appeal is directed against the order of dismissal dated 31.08.2005 passed by the learned II Additional Metropolitan Sessions Judge, Hyderabad in I.A.No.88 of 2005 in O.P. No.2256 of 2000 filed for condonation of delay of 82 days in filing the application for setting aside the ex parte award dated 14.12.2004 in O.P. No.2256 of 2000. 2.

The order impugned would show that the trial Court, after appreciating all the facts and circumstances of the case, held that the delay cannot be condoned and dismissed the I.A. There is no representation on behalf of the appellant.

Against the order of dismissal of the interlocutory application filed for condonation of delay, this appeal is filed under Section 173 of the Motor Vehicles Act, 1988. The matter requires examination. The appellant has not shown any interest to seek remedy.

Therefore, the appeal is dismissed for default. No order as to costs. Miscellaneous petitions, if any, pending in this appeal shall stand dismissed.
