HONOURABLE SRI JUSTICE P. NAVEEN RAO CONTEMPT CASE No.74 of 2016

ORAL ORDER:

This Court by order dated 6.8.2014 in W P No. 21760 of 2014 directed to allow the petitioner to participate in the verification process for recognition as majority service association which was commencing from the day after the order was passed. This contempt case is filed alleging violation of the said order.

Learned counsel for petitioner submits that as per the directions of this Court, though petitioner was permitted to participate in the verification process, he has not allowed to participate in the subsequent deliberations with the management, therefore respondent has committed contempt of Court order.

Perusal of the order passed by this Court dated 6.8.2014 would show that the petitioner was permitted to participate in the verification process and learned counsel for petitioner also fairly submitted that petitioner was permitted to participate in the verification process. After the verification process was completed, further steps taken by the respondent is not subject matter of the order passed by this Court. Therefore, it cannot be said that respondent has committed contempt of court order warranting initiation of contempt proceedings.

Accordingly, contempt case is closed, leaving it open to the petitioner to workout his remedies as available under law. No costs. Miscellaneous petitions, if any, pending, stand closed.
