THE HON'BLE SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.8202 OF 2011 ORDER:

This Criminal Petition is filed by the petitioner-A5 under Section Cr.P.C.

seeking to quash the proceedings in C.C.No.70 of 2010 on the file of the II Addl. Judicial Magistrate of I Class, Eluru, West Godavari District.

Heard the learned counsel for the petitioner-A5 and the learned Public Prosecutor appearing for the 1st respondent-State.

Learned counsel for the petitioner submits that there are no allegations against the petitioner-A5. But, the complaint shows that there is specific allegation made against the petitioner-A5 that she knocked the doors and fisted the complainant. Moreover, charge sheet is filed against the petitioner and other accused. The remedy of the petitioner is to file discharge petition before the Court below.
