THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.15742 of 2017 ORDER:

Grievance of petitioner is that though he had supplied polythene bags to the respondents in terms of the agreement, they have made only part payment and are not paying balance amount. Hence, he filed the present Writ Petition seeking to issue a direction to the respondents to make the payment for the goods supplied by him.

Considering the nature of relief which the petitioner is seeking and in view of the fact that there being any effective alternative mechanism available to ensure payment to the small scale industry under the Micro, Small and Medium Enterprises Development Act, 2006 (for short 'the Act'), liberty is given to the petitioner to avail the remedy available to him under the Act. Further, as and when the petitioner approaches the competent authority under the Act ventilating his grievance, such authority shall consider and redress the same expeditiously, in terms of the notified Regulations.

Granting liberty to the petitioner as above, the Writ Petition is dismissed.
