Since these two writ petitions are interrelated, this court deems it appropriate to dispose of the writ petitions by this common order.
The grievance of the petitioners in W.P.No.21128 of 2016 is alleged inaction on the part of the official respondents therein, in taking action for curtailing aquaculture undertaken by the respondent Nos.6 to 15 in W.P.No.21132 of 2018.
The grievance of the petitioners in W.P.No.21132 of 2018 is alleged inaction on the part of the official respondents in considering their applications to grant permission for digging and carrying on the fresh water aquaculture.
According to the petitioners in WP.No.21128 of 2016 the request of the unofficial respondents, who are petitioners in W.P.No.21132 of 2018, cannot be considered having regard to the clause in G.O.Ms.No.7, Animal Husbandry, Dairy Development and Fisheries(Fish.II) Department, dated 16-03-2013.
Since the issue is pending consideration before the respondent-authorities, this court deems it appropriate to dispose of these two writ petitions keeping it open for the petitioners in W.P.No.21128 of 2016 to file objections before the respondent-authorities, in addition to the objections already raised, within a period of two(2) weeks from the date of receipt of a copy of this order on the applications submitted by the petitioners in W.P.No.21132 of 2018 for permission and if any objections are filed, the same be considered, appropriate action be taken strictly in accordance with law as expeditiously as possible preferably within a period of two(2) months from the date of receipt of a copy of this order. No order as to costs. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
