O R D E R
The case of the petitioners is that they are the owners of the premises bearing No.7-1-418 and 7-1-518 respectively located at Old Labour Adda, Mankamma Thota, Karimnagar Town. While so, the respondents took up the repairs of the 30 feet municipal road existing between the petitioners' premises, to make it to black tar road. The respondents 3 and 4 called the petitioners and informed them that the respondents 1 and 2 instructed them to make 30 feet road to 40 feet road at their above premises only since they at starting point of the road from main PWD Sircilla Road and asked them to vacate the premises. Thereafter, the petitioners approached the respondents 1 and 2 and represented that they have constructed the above premises with valid permissions and requested not to demolish their structures without following due process of law.
But the respondents without following due process of law and without maintaining uniformity among all owners of premises situated at either side of the said road are threatening to demolish the petitioners' structures. Aggrieved by the same, the present writ petition is filed.
This Court granted interim order on 20.12.2012 stating that no demolition shall take place without following due process of law. Heard the learned counsel for the petitioners. Sri V. Satyam Reddy, learned Standing counsel for respondent Corporation on oral instructions submits that as on today there is no proposal for widening of the said road as alleged by the petitioners and as and when such proposal is initiated, the respondent Corporation will follow due process of law.
In view of the aforesaid submission, the writ petition is disposed of directing the respondents not to effect the demolition of the properties of the petitioners for road widening process, without following
due process of law. No costs.
As a sequel, miscellaneous petitions pending if any, shall stand closed.
