HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CIVIL REVISION PETITION No. 3558 of 2018 ORDER:

The present Civil Revision Petition came to be filed assailing the order dated 23.05.2018, passed in C.M.A.No.2 of 2017, by the Agent to Government, East Godavari District, Kakinada, who remanded the matter back to the Sub Divisional Magistrate, Mobile Court, Rampachodavaram, for disposal of the same, in accordance with law, within a period of one month and maintain status-quo in all respects till then.

It is to be noted that the main grievance of the revision petitioner appears to be that he was not heard before passing the impugned order.

Since no order came to be passed on merits and the case was already remanded back to the trial Court, giving a direction to the Sub Divisional Magistrate to dispose of the same, after hearing both sides, this Court is of the opinion that no prejudice is caused to the revision petitioner, by the impugned order.

Having regard to the facts in issue, the present Civil Revision Petition is disposed of directing the In-Charge Sub Divisional Magistrate, Mobile Court, Rampachodavaram, or regular Sub Divisional Magistrate, Mobile Court, Rampachodavaram, to dispose of I.A.No.26 of 2016 in O.S.No.25 of 2016, as early as possible, preferably within a period of two months from today, in accordance

with law. Till then, Status-quo as on today to be maintained, in all respects. No costs.
