Petitioner challenges notification No.Ref.D/ 1910/ 2016 dated 26.09.2016 issued by the third respondent to appoint permanent dealer to Fair Price Shop No.28 in Kandarada Village, Pithapuram Mandal, East Godavari District.

The petitioner was the authorized dealer of subject fair price shop. Admittedly, the authorization was terminated. The termination is the subject matter of appeal, further revision and is pending consideration in WP.No.32568 of 2015. Now the grievance of petitioner is if permanent arrangement is made, in the event of success of petitioner in the writ petition, the petitioner's rights are adversely affected.

Having seen the affidavit filed and after hearing learned counsel for petitioner, this Court is of the view that the prayer is, firstly, not available and secondly, misconceived.
Assuming without expressing any final view on the issue, it has to be stated that the decision, if any taken by the third respondent pursuant to impugned notification, is always subject to the outcome of WP.No.32568 of 2015. I do not see any reason to entertain the writ petition. The writ petition fails and is accordingly dismissed. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
