This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the order dated 26.7.2016 passed in Crl.M.P.No.6084 of 2016 in C.C.No.6 of 2015 by the Additional Judicial Magistrate of First Class, Markapur.

Heard and perused the material available on record. The petitioner filed the impugned Crl.M.P. seeking to recall NBWs issued against him. But the trial Court dismissed the above Crl.M.P. under the order impugned herein. Hence, the petitioner filed this petition. Learned Additional Public Prosecutor opposed this petition. Considering the facts and circumstances of the case, the petitioner is directed to surrender before the trial Court and move an application seeking to recall NBWs issued against him afresh and on such application being filed, the trial Court is directed to recall NBWs issued against the petitioner and release him on condition of his executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the trial Court. The petitioner is directed to appear before the trial Court on all hearing dates. Accordingly, the Criminal Petition is disposed of.
