THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION Nos.40504 & 40505 of 2015 COMMON ORDER :

The petitioners are working as Anganwadi Helpers and are seeking for promotion/appointment as Anganwadi Workers in their respective villages. The petitioners challenge the recruitment notification dated 12.09.2015 to recruit fresh candidates as Anganwadi Workers. The challenge is on the ground that even though in service, eligible candidates are available, it is illegal on the part of the respondents to resort for fresh recruitment and the said action is contrary to the Circular instructions issued from time to time concerning Regulation of conditions of service of Anganwadi Helpers and Workers.

2. When the matters are taken up for consideration learned counsel for the petitioners submits that the subject matter of the writ petitions are covered by the decision of this Court in W.P.No.35622 of 2015.

3. Learned Government Pleader also states that the subject matter is covered. On instructions he further submits that there are vacancies in the respective villages and petitioners are qualified to be considered for promotion/appointment as Anganwadi Workers.

4. Having regard to the earlier judgment of this Court and following the same, the recruitment notification dated 12.09.2015 is set aside and respondents are directed to consider the claim of the petitioners for promotion/appointment as Anganwadi Workers in their respective villages as per their eligibility and suitability within a period of four (4) weeks from the date of receipt of copy of this order.

5. Accordingly, both the Writ petitions are allowed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in these writ petitions shall stand closed.
