This writ petition is filed to declare the action of respondents 3 and 5 and their subordinates in digging the land by interfering with peaceful possession and enjoyment of the petitioner over land admeasuring Ac.200 gts in Sy.No.10/4, Situated at Gaddapotharam Village, Jinnaram Mandal, Sangareddy District, without following the procedure contemplated under law, as illegal, arbitrary, unjust, unconstitutional, violation of principles of natural justice and in violation of Articles 14, 19, 21 and 300-A of the Constitution of India.

Heard the learned counsel for the petitioner, the learned Government Pleader for Revenue and the learned Standing Counsel for Gram Panchayth.

Counter affidavit on behalf of respondents 3 and 5 has been filed. The fifth respondent along with the counter has also filed a petition to vacate interim orders.

In the counter affidavit filed on behalf of respondent No.5, in paragraph No.5 thereof, it is stated that the petitioner has filed the present writ petition with mala fide intention to stall the construction of dumping yard on the instigation and aid of the adjacent realtors, and the fifth respondent to prevent inconvenience to the public at large due to pendency of the writ petition, has taken a decision to allot adjacent Government land in the same survey number vide Panchanama dated 20.12.2019 and handed over the alternate land to third respondent. It is also stated that the third respondent thereafter constructed dumping yard

shed in the newly allotted land and in proof thereof photographs have been placed on record.

Learned counsel for the petitioner submits that since the respondent authorities have now allotted alternate land for setting up of dumping yard, the grievance of the petitioner stands redressed and no further orders are necessary in the matter.

Having regard to the said submission made on behalf of the learned counsel for the petitioner, the writ petition is closed. No order as to costs.
