N.Jagruthi v. The State Of Telangana
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.21597 OF 2018 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Finance Planning for 1st respondent, Sri V.Narasimha Goud, for 2nd respondent and Sri G.Narendar Reddy, for respondents 3 and 4. 2.
Petitioner's grievance is that petitioner has made a building permission application to the 3rd respondent on 23.05.2017 online and no action has been taken by 3rd respondent in that regard.
3.
Sri V.Narasimha Goud, learned standing counsel for 2nd respondent states that the petitioner's application has been forwarded on 12.03.2018 to the 3rd respondent - Gram Panchayat. Sri G.Narendar Reddy, appearing for the respondents 3 and 4, states that the competent Gram Panchayat for sanction of the building permission is the 4th respondent Gram Panchayat and not the 3rd respondent Gram Panchayat.
4.
Since the 2nd respondent has already granted technical approval to the petitioner's building permission application, the 2nd respondent is directed to address the 4th respondent to consider sanctioning the building permission to the petitioner and communicate a copy of that proceeding to the
petitioner within three weeks from date of receipt of copy of the order. On receipt of such communication from the 2nd respondent or the petitioner, the 4th respondent shall take appropriate action thereon within four weeks thereafter. 5.
Accordingly and with the above directions, this writ petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed as consequence. There shall be no order as to costs. ______________________________ M.S.RAMACHANDRA RAO, J 03.07.2018 SS
