HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.1554 of 2015 ORDER:

The petitioner, who is accused No.2, filed this Criminal Petition under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.102 of 2014 of Kanaganapalli Police Station Anantapur District, registered for the offences punishable under Sections 147, 148, 324 and 307 read with 149 IPC and Section 7 (1) of Criminal Law Amendment Act.

At the time when the matter is taken up for hearing, it is brought to the notice of this Court that accused No.3, who stands on the same footing as that of the petitioner filed Criminal Petition No.8909 of 2014 seeking anticipatory bail and by an order dated 13.08.2014, this Court disposed of the said petition by directing the petitioner therein to surrender before the Court concerned and move for regular bail before the Court of Sessions, in which event, the learned Judge was directed to dispose of the application preferably on the same day if not at least by next day.

Having regard to the order passed by this Court in Criminal Petition No.8909 of 2014 and as the petitioner stands on the same footing as that of accused No.3, this Criminal Petition is disposed of by directing the petitioner to surrender before the concerned Court and move an application for grant of regular bail after giving notice to the Public Prosecutor, in which event the same shall be dealt with on merits in accordance with law either on the same day or atleast by next day. _____________________ C.
