HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24380 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of learned counsel for the respective parties. This writ petition is filed seeking the following relief :- " ......to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus to declare the action of the respondents herein in not settling the service benefits inspite of the written representation dt.12.6.2019 and 28.9.2019 as being illegal, arbitrary and unjust and consequently direct respondent Nos.2 and 3 herein to forthwith settle the service benefits of the petitioner ......" .

Heard Mr.G.Rajesh, the learned counsel for the petitioner and the learned Standing Counsel for respondents. It has been contended by the petitioner that he was appointed as a driver with the respondents during the year 1995 and his services were regularized in the year 1997 and he has been discharging his duties to the best satisfaction of his superiors and every one concerned. While so, disciplinary proceedings were initiated against the petitioner and he was removed from service vide order dated 29.05.2012. Thereafter, the petitioner has unsuccessfully preferred appeal, revision and I.D. Later on, the petitioner has submitted representations to the respondents on 12.06.2019 and 28.09.2019 requesting to pay the service benefits for the service rendered by him. But, so far, the respondents have not passed any orders on the said representations nor paid the service benefits to the petitioner.

Learned counsel for the petitioners submits that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioner on 12.06.2019 and 28.09.2019 and pass appropriate orders in accordance with law.

Learned Standing Counsel appearing for the respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed on the representations submitted by the petitioner on 12.06.2019 and 28.09.2019 in accordance with law.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioners on 12.06.2019 and 28.09.2019 and pass appropriate orders in accordance with law within eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
