HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION NO. 2145 OF 2015 ORDER:

The petitioner filed this petition under Section 482 Cr.P.C., seeking an order directing the court of Additional Judicial First Class Magistrate, Kothapeta, East Godavari District, to receive Crl.M.P.S.R.No. 4201 of 2014 dated 3.9.2014 and decide the matter on merits.

It is seen that the petitioner filed Crl.M.P.S.R.No. 4201 of 2014 under Section 457(1) Cr.P.C, seeking a direction from the lower court to release the cattle (44 oxen) as an interim custody to the petitioner until disposal of the case on suitable conditions. His grievance is that the said petition is not numbered by the lower court since long.

In these circumstances, since the petitioner is claiming custody of Oxen, learned Additional Judicial First Class Magistrate, Kothapeta, East Godavari District, is directed to receive Crl.M.P.S.R.No. 4201 of 2014 dated 3.9.2014 and number the same and dispose of the petition on merits expeditiously preferably within one month from the date of receipt of this order. Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
