THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36372 of 2016 ORDER:

This Writ Petition is filed by the petitioners seeking a writ of Mandamus, to call for the records relating to Crime No.120 of 2016 of Zaffargadh Police Station, Warangal District, registered for the offences under Sections 452, 332, 504, 290 and 506 r/ w.34 IPC, and quash the same.

Heard and perused the material available on record. The 3rd respondent is the Head Master and the petitioners are School Assistants in ZPSS Zaffergadh. The 3rd respondent made a complaint before the 2nd respondent stating that on 21.09.2016 at 10.30 am, he questioned the petitioners about their taking leaves frequently and not attending the classes. Thereafter, the petitioners went to his Chamber and abused him in filthy language and the 1st petitioner beat him with chapel and the 2nd petitioner beat him with hands and threatened him.

The learned counsel for the petitioners submits that the petitioners are implicated in this case falsely and they have good reputation in the society and they never quarreled with the complainant, and the petitioners apprehend arrest and harassment in the hands of police due to pendency of the present case. The learned Assistant Government Pleader submitted that on the basis of the complaint filed by the 3rd respondent, the case was registered against the petitioners and the police are investigating into the matter in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, the 2nd respondent is directed to complete the investigation in Crime No.120 of 2016 of Zaffergadh Police Station, Warangal District, and file a final report, in accordance with law in either way, without arresting the petitioners.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
