HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.24309 OF 2019 ORDER:
This Writ Petition is filed to declare the inaction of the 3rd and 4th respondents in taking action against unofficial respondents 5 to 7 pursuant to the Crime No.157 of 2019 dated 09.10.2019 on the file of 4th respondent police station, as being illegal and arbitrary.
Heard the learned Counsel for the petitioner and learned Assistant Government Pleader for Home. Learned Assistant Government Pleader for Home, on written instructions dated 08.11.2019, submits that on receipt of the complaint from the petitioner, a case was registered in Crime No.157of 2019 under Section 302, 304-B read with 34 IPC of Ramakrishnapur police station on 09.10.2019. It is further stated that during the course of investigation, L.Ws-1 to 4 were examined and their statements were recorded, sent the dead body to post mortem examination, prepared scene of offence panchanama, arrested the accused No.1 on 22.10.2019 and sent him to judicial custody. By the said written instructions, it is also stated that as per the evidence collected, it disclosed that the accused Nos.1 to 3 harassed the deceased to bring additional dowry of Rs.5 lakhs and for not begotting any child, due to
the unbearable harassment of the accused person, the deceased committed suicide and that after obtaining PME report as Section 302 IPC is not attracted, as such Section 304-B IPC was added. It is also stated that the case is under investigation for collection of FSL report and for arresting the remaining absconding accused 2 and 3.
Inasmuch as the 4th respondent has taken effective steps in investigating into the crime which was registered on the basis of the complaint of the petitioner, this Court is of the view that no further orders need be passed in this matter. Recording the above submission of the learned Assistant Government Pleader, the Writ Petition is closed. No order as to costs.
The miscellaneous petitions pending, if any, shall also stand dismissed.
