THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6904 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.56 of 2022 on the file of Damargidda Police Station, Narayanpet District, registered for the offences punishable under Sections 366, 376 (3) OF Indian Penal Code and Section 5(1) read with 6 of POCSO Act, 2012 and Section 3(2)(v) of the SC/STs (POA) Act, 1989.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that he and the victim girl are acquainted with each other and fell in love. According to the statement of the victim girl while she was alone in her house, in the afternoon time, the petitioner had sexual intercourse with her stating that he would marry her. The parents of the victim girl, noticing their relation admonished them. On 17.06.2022 while the victim girl was alone,
petitioner went to her and took her to Hyderabad where they rented a house at Kukatpally, by informing the house owners that they were husband and wife. When she came to know that a police case was filed regarding her disappearance, the petitioner took her to Damargidda and left her there and went away.

Even according to the investigation, the petitioner and the victim girl were in love with each other over a period of one year and having decided to marry they went and stayed for some time at Kukatpally.

In the said circumstances, the petitioner can be granted the relief of bail of bail subject to the following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of Additional Judicial First Class Magistrate, Kosgi.
ii) The petitioner/Accused, after release shall not in any manner try to contact either the victim girl or her parents, failing which, the police are at liberty to seek cancellation of bail.
iii) The petitioner/Accused, after release shall appear before the concerned Police Station between 10.30
A.M. to 1.00 P.M., every Monday for a period of eight weeks, for the purpose of investigation.
iv) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 6.
Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
