THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6901 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/Accused Nos.2 to 4 seeking pre-arrest bail in the event of their arrest in connection with Cr.No.114 of 2022 on the file of Yellandu Police Station, registered for the offences punishable under Section 420 of IPC and Section of Protection of Depository Financial Establishment Act, 1999 and Section 4 of Chit Funds Act. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

It is alleged by the prosecution that these petitioners along with A.1 collected amounts from various persons and failed to repay. The de facto complainant filed the present complaint on the allegation that these petitioners along with A.1 were running Rs.2.00 lakhs chits. However, praise money was not paid to the de facto complainant and several others. The said complaint was filed on 13.5.2022. A.1 namely D.Sankaraiah filed an insolvency petition on 16.04.2022 pursuant to which the present complaint is filed.

In the said circumstances, the petitioners who are family members of A.1 shall be enlarged on bail in the event of their arrest, subject to the following conditions:

1) The petitioners/Accused Nos.2 to 4 are directed to surrender before the Station House Officer, Yellandu Police Station, within ten days and on such surrender, the said Station House Officer, shall release the petitioners/Accused 2 to 4 on bail, on their executing personal bonds each for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner No.1/Accused No.3 shall appear before the police on every Monday for a period of eight weeks and Petitioners 1 and 3 / accused Nos.2 and 4 shall appear before the police as and when required, for the purpose of investigation.

3) The petitioners/Accused Nos.2 to 4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
