PNR,J W.P.No.9218 of 2010 HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

This writ petition is filed directing respondents to consider the case of petitioner for regularization of service as Health Volunteer in Government Tribal Welfare Ashram Schools/Hostels of Rampachodavaram Mandal, East Godavari district. 2.

At the stage of admission, by order dated 22.04.2010, Court directed continuation of petitioner on the same terms and conditions existing as on that date. It appears from the material on record, petitioner was continuing as Volunteer on honorarium basis.

When the matter is taken up for consideration, learned Assistant Government Pleader produced copy of the letter of Head Master, T.W.A.U.P.School, Vootla, Rampachodavaram, dated 29.09.2012, which is in the form of certificate, stating that petitioner has not worked in the institution during the academic year 2012-13, as per the school records. This statement is not denied. If that is so and when petitioner is not working, question of granting direction, even assuming that petitioner has valid claim for regularization of service, cannot be issued. Therefore, writ petition is liable to be dismissed and is accordingly dismissed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
