THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.24312 of 2019 ORDER:

The present writ petition is filed to declare the action of the 3rd respondent-Sub. Inspector of Police, Mulakalapalli Police Station, Bhadradri Kothagudem District, in not registering the case and not receiving the complaint against the 4th respondent, as being illegal, arbitrary, null and void. Heard Sri K. Durga Prasad, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the official respondents 1 to 3 and Mrs. K.V. Rajasree, learned counsel representing Smt. T. Pushpa Rani, learned counsel for 4th respondent.

The main grievance of the petitioner in the present writ petition is with regard to the inaction of the official respondents in not registering the case on the basis of the complaint made by the petitioner.

The learned Assistant Government Pleader for Home, on written instructions dated 13.11.2019, a copy of which is placed on the record of this Court, submits that based on the complaint made by the petitioner, which has been received by the said authority on 12.11.2019 at 12:00 hours, a case was registered in Crime No.120 of 2019 of Mulkapalli Police Station for the offences punishable under Sections 447 and 427 of the Indian Penal Code, 1860 and the case is under investigation.

Having regard to the above, since a case is registered, the grievance of the petitioner in the present writ petition stands redressed and no further orders need be passed in the matter, except observing that the respondent police authorities having registered a case shall investigate into the case in accordance with law.

Subject to the above observation, the writ petition is closed. Pending miscellaneous petitions, if any, pending in this writ petition shall stand closed, in the light of this final order. No order as to costs.
