HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.35540 OF 2015 ORDER:

When the matter is taken up for hearing, counsel for the petitioner had contended that the 4th and 5th respondents have encroached upon the land of the petitioner and obtained electrical service connection. Counsel for the petitioner had further contended that the issue about the ownership of the land has been adjudicated in favour of the petitioner, in O.S.No.

278 of 2008 by the competent civil court, and the petitioner has submitted a representation to the respondents to take appropriate action against the 4th and 5th respondents in accordance with law and to remove electrical service connection granted in favour of the 4th and 5th respondents, but so far the official respondents have not initiated any action against the 4th and 5th respondents and also not disconnected power supply to the electrical service connection granted in favour of the 4th and 5th respondents. Therefore, counsel for the petitioner contended that appropriate orders be passed in the writ petition directing respondent Nos.1 to 3 to take appropriate action on the representation submitted by the petitioner on 09.05.2015.

Standing counsel appearing for the respondents had contended that since the petitioner's representation is pending with the official respondents, the official respondents would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the submissions of learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing respondent Nos.1 to 3 to initiate appropriate action on the representation submitted by the petitioner on 09.05.2015 within a period of eight weeks from the date of receipt of a copy of this order.

With the above directions, the writ petition is disposed of. No order as to costs.
