This writ petition is filed for the following prayer. ".... to pass an order of Writ of Certiorari calling for the records pertaining to the petitioners of the respondent No.3 and 4 herein in issuing the revocation orders vide letter No.HMDAL103245/LRS/GTK/Plg/HMDA/20152016, dated 28.10.2019 in cancelling the LRS approval which was granted earlier on 10.07.2017 in favour of the petitioner No.1 herein in respect of Plot Nos.18 & 19 in Sy.No.79/E, situated at Peerjadiguda Village, Medipally Mandal, Medchal, Malkajgiri District and quash the same as against the principles of natural justice, rules of law, equity, arbitrary, illegal and pass any orders for which the petitioners are legally entitle and this Hon'ble Court deems fit and proper in the circumstances of the case to meet the ends of justice."
Heard learned counsel for petitioners and counsel appearing for respondent No.6.
Sri V.Narasimha Goud, learned Standing Counsel appearing for respondents 2 to 4 (HMDA) fairly submits that show cause notice was sent to the 1st petitioner by ordinary post on 07.08.2019, as such, no acknowledgment could be produced.
He also handed over a copy of the show cause notice to the petitioner's counsel, today.
In view of the same, this Court, without going into the merits of the matter, set aside the impugned order dt.28.10.2018 only on the ground of violation of principles of natural justice. Further, the petitioner is directed to file explanation to the said show cause notice within a period of four weeks from today. On such explanation being filed by the petitioner, the respondents shall consider and dispose of the same, in accordance with law and take action accordingly. If respondent No.6 has any grievance it is open for him to agitate his rights, in accordance with law.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
