HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.12024 of 2015 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Home.

The petitioners complain that the 4th respondent is illegally and unlawfully interfering with the peaceful possession of their properties bearing H.Nos.16-8-46/3, 16-8-46/4 and 16-8-46/5 situated at Abbanikunta, Warangal, and threatening them to handover documents of the properties in question to third parties. Learned Government Pleader has received instructions, which state that as on date, no complaint whatsoever is received or registered against the petitioners before the 4th respondent Police Station and that the 4th respondent never interfered with the properties in question nor asked the petitioners to produce relevant documents. It is further stated that the respondent police never summoned the petitioners nor sent any constable to the petitioners' house for the purpose of investigation.

The allegations of the petitioners that the respondent police summoned them on 19-04-2015 and was forced to sit in the police station after summoning were denied. It is also stated that the respondent police are only concerned with maintenance of law and order and they will take action only if any crime is registered against the petitioners but not otherwise. In view of the said categorical statement that no case is pending against the petitioners and that police never interfered with the civil dispute, the same is recorded and no further orders are necessary. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.
