The grievance of the petitioner is that he made complaint on 25.04.2018 before the 5th respondent against respondents 6 to 8 as they have damaged his crop by trespassing into his land. As no action is being taken on the said complaint, present writ petition is filed. Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Home produced written instructions stating that civil litigations in OS.No.69/2010, 79/2010 and SA.No.245/2015 are pending in respect of the subject land; and that on the enquiry it is found that it is purely in civil nature and the same was also informed to the petitioners. The other allegations made by the petitioner are denied by the respondents.
The same is disputed by the learned counsel for the petitioner.
In view of the same the respondent police are directed to take action on the complaint of the petitioner by following the guidelines of the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh (2014) 2 SCC 1, if not already taken.
Accordingly, the writ petition is disposed of. No order as to costs.
