HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22743 OF 2014 And WP.MP.No.45269 of 2014 ORDER:
Learned counsel for the petitioners states that in the writ petition, instead of mentioning Patta No.497, it was mentioned as Survey No.497 and that a petition was also filed in WP.MP.No.45269 of 2014 for amending the same. A reading of the affidavit goes to show that nowhere, in the writ affidavit it is stated that the petitioner was granted any Patta, and when the same is pointed out by this Court, learned counsel for the petitioners sought permission of this Court to withdraw the writ petition with liberty to file fresh writ petition. In view of the above, permission is accorded. Accordingly, the writ petition as well as WPMP are dismissed as withdrawn granting liberty to the petitioner to institute fresh writ petition by mentioning correct facts. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
