HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7382 of 2016 ORDER:

The petitioner challenges the action of the respondents in suspending her authorization vide proceedings dated 01.09.2015 in respect of Shop No.7, Bonala Village, Lingala Mandal. When the matter was listed on 08.03.2016, the learned Government Pleader sought time to get instructions. Today, the learned Government Pleader places on record the order dated 09.03.2016, wherein it is shown that the suspension of authorization of the petitioner has been extended by proceedings dated 07.01.2016.

On the other hand, the learned counsel for the petitioner states that on 09.03.2016 the Authorities approached the petitioner and wanted to serve some papers and when the petitioner insisted for putting a date, they did not serve the same on her. Having perused the record and considering the submissions made by both the parties, there is no reason for not trusting the submission made by the learned counsel for the petitioner that no extension of suspension orders were served on the petitioner. Though learned Government Pleader seeks time to get instructions to verify whether the suspension orders have been served or not, I am not inclined to adjourn the matter. As the Authorities ought to have been instructed the learned Government Pleader at the very first instance and no specific plea has been

made that the same were not served but an attempt to serve has been made.

In that view of the matter, it is obvious that the attempt on the part of the 3rd respondent to extend the suspension order is a vague plea. Hence, there shall be a direction to the 3rd respondent to restore the authorization in favour of the petitioner forthwith. With the above direction, the writ petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petitions shall stand closed in consequence. No order as to costs.
