HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 28478 OF 2017 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the 3rd respondent in terminating the petitioner from service by order No.HR/12/2016, dated 10.12.2016 as illegal and arbitrary and consequently to set aside the same.

Heard learned counsel for the petitioner and Sri G.Narender Reddy, learned Standing Counsel for the 4th respondent.

Learned counsel for the petitioner submits that without issuing any notice, the petitioner was straight away terminated from service, which is in violation of principles of natural justice.

On the other hand, learned Standing Counsel for 4th respondent submits that the impugned proceedings are only suspension pending enquiry and that the petitioner had already been issued notice on 02.08.2017.

Learned counsel for the petitioner submits that as on today no notice was served on the petitioner. In view of above facts and circumstances, learned Standing Counsel for the 4th respondent to serve copy of notice on the counsel for the petitioner and it is open for the

petitioner to submit explanation to the same within a period of two weeks from today and it is open for the competent authority to pass orders in accordance with Rules on the explanation filed by the petitioner, after giving an opportunity of hearing to him, within a period of four (4) weeks thereafter. However, if the competent authority fails to pass appropriate orders on such explanation, petitioner shall be reinstated into service, pending enquiry.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
