THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.2751 OF 2017 ORDER:

Heard Mr.K.Raghuveer Reddy, for petitioners, learned Government Pleader for Revenue for respondents 1 and 2 and Mr.Rajagopallavan Tayi for 3rd respondent. The Joint Sub Registrar, Tandur, Ranga Reddy District is present in the Court.

The petitioner prays for mandamus declaring settlement cancellation deed bearing No.6334/2016, dated 27.12.2016 as illegal and beyond the jurisdiction of the 2nd respondent.

3. The said document was admitted for registration and registered at the instance of the 3rd respondent. The circumstances are not in dispute but the objection centres around unilateral cancellation carried out by respondents 1 and 2.

Mr.Rajagopallavan Tayi, learned counsel for 3rd respondent, submits that the unilateral cancellation of a settlement deed by 3rd respondent by executing the subject deed is unsustainable. He consents to setting aside deed bearing document No.6334/2016 and give opportunity to 3rd respondent to work out remedies, in accordance with law, by filing a suit. The statement is placed on record and liberty as prayed for is granted to 3rd respondent.

Having regard to the consent, the registration of document bearing No.6334/2016, dated 27.12.2016, is recalled and cancelled.

The 2nd respondent undertakes to make necessary entries to this effect in the registers maintained under the Registration Act.
