HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.16998 OF 2003 ORDER:

This writ petition is filed seeking a writ of Certiorari calling for the records in Appeal No.2 of 2003 dated 20.6.2003, on the file of Commissioner of Endowments Department, Government of Andhra Pradesh, where under the Commissioner upheld the orders of the 2nd respondent-Executive Officer, herein vide proceedings dated 3.11.2001, and quash the same as invalid and without jurisdiction.

When the matter is taken up for hearing, it has been contended by the learned counsel for the petitioner that the petitioner was appointed as a 'Record Assistant' and as a disciplinary measure, the disciplinary authority has imposed the punishment of reversion to a post of Junior Assistant. The settled service jurisprudence is that a directly recruited candidate at best can be dismissed or removed and cannot be imposed a punishment of reversion as temporarily. The punishment imposed on the petitioner is contrary to the settled legal proposition. However, learned counsel for the petitioner submits that the petitioner is continuing as 'Record Assistant' in terms of interim suspension orders granted by this Court. At this point of time, as the petitioner was continuously working as 'Record Assistant', in terms of the interim orders granted by this Court, ends of justice would be met, if the petitioner, is permitted to work as a 'Record Assistant'.

With these observations, the writ petition is closed. No order as to costs.
