THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15198 of 2012 ORDER:

This writ petition was filed challenging the Endorsement in R.C.F.No.9-110147/2012 dated 15.03.2012 directing the petitioners to pay the licence fee, pursuant to the resolution No.18/18 dated 16.04.2012. The said resolution is not challenged and the consequential Endorsement is challenged in the present writ petition.

The petitioners state that there was an abnormal and arbitrary increase in the Trade Licence Fee from Rs.2,396/- to Rs.21,950/- and Rs.35,490/- respectively and it affects the activities of the petitioners. It is also the case of petitioners that they have filed objections on 27.02.2012.

The impugned Endorsement took into consideration the representations of petitioners dated 01.03.2012 and the remarks submitted by the Sanitary Inspector dated 09.03.2012. If the petitioners are aggrieved with the enhancement of Trade Licence Fee, they have to challenge the basic resolution, as the Endorsement was issued in pursuance of the resolution. In the absence of any challenge to the resolution, the Endorsement cannot be held to be bad, and accordingly, this Writ Petition is dismissed. No order as to costs. However, it is open to the petitioners to challenge the resolution, if they are aggrieved.
