THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6947 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A7 seeking bail in the event of his arrest in connection with C.O.R.No.16 of 2022 on the file of Excise Police Station, Gadwal, Jogulamba Gadwal District, under Section 34 (a) of the T.S.Excise Act, 1968.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the excise police, Gadwal, is that they have seized 35 liters of ID liquor from A1 to A5 and 35 liters from A6. The accused Nos.1 to 5 disclosed that this petitioner and another were involved in the crime. Accordingly, when A1 to A6 were remanded to custody, this petitioner was shown as A7 and absconding.

Learned Counsel for the petitioner submits that this petitioner is a car owner in which ID liquor was found and he is nothing to do with the said carrying of ID liquor by the accused Nos.A1 to A5.

In the said circumstances, when no seizures are affected at the instance of this petitioner and the basis for implicating this

petitioner is confession of Accused No.1, this petitioner can be granted the relief of Anticipatory Bail in the event of his arrest, subject to the following conditions:

1) The petitioner/A7 is directed to surrender before the Station House Officer, Excise Police Station, Gadwal, within a period of ten days from the date of this order. On such surrender, the said Station House Officer, shall release the petitioner/A7 on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A7 shall appear before the police every day between 10.00 a.m. to 1.00 p.m. for a period of four weeks, for the purpose of investigation.

3) The petitioner/A7 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
