THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6905 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused seeking pre-arrest bail in the event of his arrest in connection with Cr.No.166 of 2022 on the file of Mallial Police Station, registered for the offences punishable under Section 307 and 294 (b) of IPC.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The allegation against the petitioner is that he entered into a fight with the de facto complainant's husband in a drunken state. It is however alleged by the de facto complainant that there are civil disputes pending amongst them.

The learned counsel for the petitioner submits that the injuries said to have been received by the injured are simple in nature and that due to political rivalry he has been implicated in three cases altogether. 4.

Since the injuries received by the de-facto complainant are simple in nature, the petitioner can be granted the relief of anticipatory bail and shall be enlarged on bail in the event of his arrest, subject to the following conditions:

1) The petitioner/Accused is directed to surrender before the Station House Officer, Mallial Police Station and on such

surrender, the said Station House Officer, shall release the petitioner/Accused on bail, on his executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner /Accused shall appear before the police on every day for a period of 30 days from the date of surrender for the purpose of investigation.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
