THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37725 of 2016 ORDER:

This Writ Petition, under Article 226 of Constitution of India, is filed to call for the records relating to Crime No.754 of 2016 of Saroornagar Police Station, Cyberabad and quash the same. 2.

Heard and perused the material available on record. 3.

Respondent No.4-de facto complainant lodged a complaint against the petitioners' driver for the alleged accident, resulting in injures to the brother of the complainant, for which a case in Crime No.742 of 2016 of Saroornagar Police Station, under Section 337 IPC, was registered. The 4th respondent filed another complaint on 25.10.2016 stating that when he went to Saroornagar Police Station with regard to registration of Crime No.742 of 2016, the petitioners threatened and abused him attracting the provisions of SCs & STs Act, which resulted in filing Crime No.754 of 2016.

Learned counsel for the petitioner submits that the complainant with a mala fide intention lodged the present complaint against the petitioners; that the complainant is stranger to the petitioners; that none of the acts stated in the complaint constitute the offences alleged against the petitioners; and hence, he prays to quash the proceedings in Crime No.754 of 2016.

Having regard to the facts and circumstances of the case and also taking into consideration the submissions made by learned counsel for the petitioners, the Writ Petition is disposed of directing the 3rd respondent to complete the investigation in Crime No.754 of 2016 as

expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. In case, if any charge sheet is filed and summons were issued to the petitioners, they shall appear before the Court concerned and execute personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety to the satisfaction of the Court concerned for their future appearance before that Court.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
